GENERAL INFORMATION:

INSPECTION OBLIGATION, ETC:
Basis for the allocation of responsibility;
According to the Swedish Land Code, the property must correspond to what has been agreed upon between the parties and must not deviate from what the buyer could reasonably expect at the time of purchase. Furthermore, it is purchased in the condition it is in on the contract date, and the buyer must conduct a thorough inspection of the property to secure themselves. The seller is not liable for defects or damages that the buyer could have discovered or anticipated due to the age and condition of the property. However, the seller is responsible for hidden defects, i.e., defects in the property that the buyer could not have discovered, regardless of whether the seller was aware of the defects or not. The seller's liability for hidden defects in the property lasts for 10 years.
Buyer's Inspection Obligation:
The buyer is required to inspect the property thoroughly. If the buyer discovers any defects or signs of defects in the property, or if the property is in such a condition that defects can be suspected, the buyer's inspection obligation increases. The information provided by the seller also affects the extent of the inspection obligation. If the seller informs the buyer of a suspected defect, it should prompt a more thorough inspection by the buyer. However, the buyer is not required to inspect parts of the property for which the seller has provided explicit assurances or warranties, provided they are not general in nature. The buyer should keep in mind that the seller is not liable for defects or deficiencies that the buyer should have expected due to the age, price, condition, and use of the property. Therefore, the buyer should tailor their inspection accordingly.
Engagement of a Surveyor:
The Swedish Land Code assumes that the buyer should be able to fulfill their basic inspection obligation on their own, and it is not a requirement to engage an expert for this purpose. However, most buyers choose to hire a surveyor or other expert, especially if they lack specific building technical knowledge. The same applies if the buyer has initially inspected the property themselves and discovered signs of defects that are difficult to assess. The buyer should engage a surveyor to ensure a comprehensive inspection of the property. If the buyer engages an expert, it is important to note the scope of the inspection. Usually, such inspections do not cover certain parts of the property, such as electrical installations, water and sewage systems, chimneys, etc., so the buyer may need to supplement their inspection.
Seller's Disclosure Obligation:
There is no general disclosure obligation equivalent to the buyer's inspection obligation. The relevance of whether an actual defect is relevant or not depends on whether the defect is detectable by the buyer. Only if the defect is not detectable is it relevant. However, the seller may be obligated to provide information if they knew or should have known about the defect but did not inform the buyer. If the failure to disclose a defect involves fraudulent or other dishonest behavior, the seller may forfeit the right to claim that the buyer did not fulfill their inspection obligation. It is therefore in the seller's best interest to inform the buyer of any known defects or suspected defects. What the seller discloses is not considered hidden and generally cannot be invoked by the buyer.
